Our firm assists and advises building owners or their agents, architects and engineering firms, and contractors, as well as their insurers, in the context of their construction project issues. 

We advise our clients from the contractual set-up of the construction project to the drafting of construction contracts (real estate development contract, delegated project management contract, project management assistance contract, single-family house construction contract, design and engineering contract, project management contract, general contractor agreement, subcontracting contract, long-term lease, construction lease and real estate leasing).

Before work starts, we obtain an ‘as is’ inventory of fixtures to reduce the risk of disputes with neighbors (abnormal neighborhood disturbance) or builders during and after completion of the work.

While the work is being carried out, our firm requests emergency measures to be taken, in particular to preserve evidence, hold contractors liable and be granted the benefit of construction bonds (for the completion of property development projects or single-family homes) and insurance policies (construction all-risk, damage to building work and property on site) applicable before acceptance of the work. 

After the acceptance of the work, we handle liability disputes and construction warranties (1-year defect liability period, 2-year product warranty, 10-year warranty of good workmanship) for building owners and stakeholders (contractors), as well as coverage from their insurers (general liability insurance for building owners and for contractors, damage to building work), and brings subrogation claims and recovery actions to preserve our clients’ assets. 

In addition, LEXASSURE manages financial litigation for contractors (contract settlement, direct payment to subcontractors, security deposit) and contract bond providers (security deposit, performance bond, payment of subcontractors).
